Terms of Service
Effective from 22 October 2026.
1. About these terms
These Terms of Service ("Terms") govern access to and use of Payroll by Briltus (the "Service"), an online payroll software service provided by Briltus, Hyderabad, Telangana ("we", "us", "our"). By creating an account, starting a free trial or using the Service, you agree to these Terms on behalf of the organisation you represent ("you", "Customer"). If you do not agree, do not use the Service.
2. The Service
The Service helps you calculate salaries and statutory deductions (Provident Fund, ESI, Professional Tax and income tax deducted at source), run monthly payroll, produce payslips, letters, reports and statutory files, and give your employees a self-service portal.
The Service applies the rules we have configured for each financial year to the information you enter. You remain responsible for the accuracy and completeness of the data you enter, for reviewing the results before you pay salaries, and for making statutory payments and filings on time. The Service is a tool; it is not legal, tax or accounting advice. Please consult a qualified professional for advice specific to your organisation.
3. Your account
- You must provide accurate registration details and keep them up to date.
- You are responsible for all activity under your organisation's account, including by the staff users you add, and for keeping passwords and sign-in methods secure. Tell us promptly at info@briltus.com if you suspect unauthorised access.
- You confirm that you are authorised to enter and process the personal data of your employees in the Service, and that you have given them any notices required by law.
4. Free trial and plans
- New accounts receive a free trial with the limits shown on our pricing page. No payment is collected during the trial.
- At the end of the trial you may choose a paid plan or the Free plan, if your organisation is within its limits.
- Each plan includes the features and limits (employees, staff users) shown on our pricing page at the time you subscribe.
5. Fees, payment and taxes
- Paid plans are prepaid, monthly or yearly, at the prices on our pricing page. Goods and Services Tax (GST) is charged in addition, and a GST invoice is issued for every payment.
- Plans do not renew automatically; you renew from Plan & Billing before the paid period ends.
- Upgrades take effect immediately and you pay the pro-rated difference for the rest of the current period. Downgrades take effect from the next renewal.
- We may change prices for future periods. Changes do not affect a period you have already paid for.
- Payments are processed by our payment gateway partner or by bank transfer. We do not store card or UPI details.
6. Cancellation and expiry
You can cancel at any time from Plan & Billing; your plan stays active until the end of the period already paid for. When a paid period ends without renewal, your account moves to the Free plan if it is within the Free plan's limits; otherwise it becomes read-only, and you can still view and download your payslips, reports and documents. Refunds are governed by our Refund & Cancellation Policy.
7. Acceptable use
You agree not to: (a) access or attempt to access another customer's data; (b) probe, scan or test the Service's security, or interfere with its operation; (c) copy, resell, reverse engineer or build a competing product from the Service; (d) upload malicious code; or (e) use the Service for any unlawful purpose or in breach of these Terms.
8. Your data
You own the data you enter into the Service ("Customer Data"). You grant us the right to host, process and display Customer Data only to provide, secure and support the Service and as described in our Privacy Policy. For the personal data of your employees, you are the data fiduciary and we process it on your behalf. You can download a complete copy of your Customer Data at any time from Settings → Data export.
9. Confidentiality and security
We keep Customer Data confidential and protect it with reasonable technical and organisational measures, described in our Privacy Policy. Our staff access Customer Data only when needed to provide support you have asked for, to keep the Service running or as required by law.
10. Availability, support and changes
We aim to keep the Service available at all times but do not guarantee that it will be uninterrupted or error-free; planned maintenance is scheduled outside Indian business hours where possible. Support is available by e-mail at info@briltus.com. We may improve and update the Service, including to reflect changes in law. We will notify you in advance of changes to these Terms that materially affect you; continuing to use the Service after the change takes effect means you accept the updated Terms.
11. Intellectual property
The Service, its software, design and content (other than Customer Data) belong to us or our licensors. You receive a limited, non-exclusive, non-transferable right to use the Service during your subscription, in line with these Terms.
12. Disclaimers
Apart from what is expressly stated in these Terms, the Service is provided "as is". To the extent permitted by law, we disclaim all implied warranties, including fitness for a particular purpose.
13. Limitation of liability
To the extent permitted by law: (a) our total liability for all claims relating to the Service in any twelve months is limited to the fees you paid us for the Service in those twelve months; and (b) we are not liable for indirect, incidental or consequential losses, loss of profit, or for interest, penalties or damages arising from inaccurate data entered by you or from statutory payments or filings not made on time.
14. Indemnity
You will indemnify us against third-party claims arising from Customer Data you enter without the right to do so, or from your breach of these Terms or of applicable law.
15. Suspension and termination
We may suspend or terminate access if you materially breach these Terms and do not remedy the breach within a reasonable time after notice, or immediately where needed to protect the Service or other customers. On termination, you may download your data as described in our Privacy Policy.
16. Governing law and disputes
These Terms are governed by the laws of India. Subject to applicable law, the courts at Hyderabad, Telangana have exclusive jurisdiction over any dispute relating to them. We encourage you to contact us first at info@briltus.com so we can try to resolve any concern quickly.
